Electronic commerce via Internet in Italy is governed by current regulations on distance selling. The law (Legislative Decree 06/09/2005 no. 206) guarantees the right to withdraw for any reason from the purchase contract, without penalty and without specifying the reason, within 14 working days from the date of receipt of the ordered goods.

This website is owned by Aromatica s.r.l. via Trieste Gorgonzola Italy and is dedicated to online sales. Aromatica s.r.l. observes the law on distance selling (D.L. 06/09/2005 no. 206) which provides precise duties for the seller and precise rights for the consumer.

Therefore, we urge you to read the conditions below carefully, and to keep them in case of purchases on the www.zaffy.it website. All sales, delivery and payment methods are listed in detail.

1. OUR PRODUCTS
Our products are designed and selected by our team of Italian specialists, are patented and subject to copyright. Aromatica s.r.l. reserves the right to make technical, constructional and dimensional changes useful for their improvement at any time.
Product photographs are indicative because they are subject to typical variations in photographic and printing processes. All trademarks appearing on the pages of this site are the legitimate owners.

2. OFFER TO THE PUBLIC
This article is addressed to the “consumer” end user, i.e. any natural person acting for purposes not related to his or her trade, business or professional activity.
For companies or resellers, please refer to the reserved sections. The sales prices of the products shown on the site include VAT.
Prices do not include transport costs (both within and outside Italy), which are calculated at the time of purchase.

3. PURCHASE METHOD AND ORDER ACCEPTANCE
The purchase procedure is as follows: select the product and access the product sheet; if you wish to purchase, click add to cart and then click cart. You can proceed either as a guest or as a registered user (recommended).

The registration procedure is quick and easy. The next steps involve confirming the shipping/delivery address, choosing the shipping method, calculating the shipping costs, paying by credit card or PayPal account, and confirming the transaction. A confirmation email will follow.

4. DELIVERY TERMS
The products purchased will be delivered to the address indicated during registration. The average delivery time is approximately 2/3 working days in Italy (islands require an extra day). No responsibility can be attributed to Aromatica s.r.l. for delayed or non-delivery due to force majeure or fortuitous events.
Each shipment includes a transport document and, if requested, an invoice. The products are contained in cardboard boxes of different sizes, sealed at the top and bottom with customised adhesive tape.
The consumer shall, upon receipt, verify the conformity of the product in relation to the order placed and the following steps:

• That the number of packages (number of packs) indicated on the carrier’s letter corresponds to the number of packages actually delivered.

• That the package is undamaged, not damaged or wet, and otherwise conforms to the standard characteristics (described above).
Only after such verification shall the Customer sign the delivery note, after which he shall not be able to raise any objection about the external characteristics of what is delivered to him in relation to the order placed. If, on the other hand, there is no correspondence between the order and the delivery, according to the aforementioned procedures, the customer shall not accept the goods and shall raise the objection directly to the carrier.

5. RIGHT OF WITHDRAWAL
The Consumer’s right of withdrawal is governed by Articles 64 et seq. of Legislative Decree 06/09/2005 no. 206. The Consumer has the right to withdraw from the contract, even partially, without explanation and without incurring any expenses, provided that the following procedures are complied with:

• Withdrawal must be notified to Aromatica S.r.l., by e-mail, info@zaffy.it, within 14 working days from the day of receipt of the products.

• This communication shall specify the reference charge, the wish to withdraw from the purchase and the product(s) for which the right of withdrawal is to be exercised, and attach a copy of the transport document or of the order placed.
• The consumer shall return the product at his or her own expense by sending it to the following address: of the sender, Aromatica s.r.l.

If the withdrawal has been exercised in accordance with the procedures described, Aromatica s.r.l. will refund the full amount paid for the purchase as soon as possible and in any case within 30 days from the date on which Aromatica s.r.l. became aware of the consumer’s exercise of the right of withdrawal. The refund shall include the amount paid for delivery of the product. Only the costs of returning the product shall be borne by the Consumer. The right of withdrawal is not permitted, pursuant to and for the purposes of Article 55 of Legislative Decree 06/09/2005 no. 206, in the case of:

• Purchase of audio-visual products or software packaged sealed and opened by the consumer.
• Of tailor-made or customised goods.
• Of goods that by their nature cannot be returned or are liable to deteriorate or alter rapidly.

6. ORDER CANCELLATION AND/OR MODIFICATION
In addition to the provisions of paragraph 5, the consumer may cancel the entire order or change it no later than 12 hours after placing it.

In order to change or cancel the order it is necessary to send notice to the customer service Aromatica s.r.l. by e-mail at info@zaffy.it always indicating the online order number and the date of submission. Zaffy’s customer service shall contact the consumer again, informing them of the feasibility of the change requested.

7. PAYMENT
   Payment for the products shall be made by the consumer during the order confirmation via one of the available credit cards or via PayPal account. Aromatica Sr.l. shall not be liable for any fraudulent or illegal use of credit cards by third parties.

At no time during the purchase process is Aromatica S.r.l. able to know the buyer’s credit card number, which is transmitted via a secure connection directly to PayPal, the service provider.

8. RESPONSIBILITY
   Aromatica S.r.l. guarantees compliance with product quality standards.
9. GUARANTEES
   Purchased products are protected by the manufacturer’s guarantee, which shall only be valid for products damaged despite normal use of the product, i.e. in accordance with its intended purpose and with the provisions of any technical documentation, and in compliance with the various operating rules specified therein. On the other hand, the aforementioned guarantee shall not be applicable in the event of negligence, carelessness in the use and maintenance of the product, connection of the purchased goods to electrical installations, or any other type of connection that is not in accordance with standards.

   The guarantee is personal and shall therefore only apply to the original purchaser, as it is reserved for direct consumers and not for traders, retailers, etc. In any case, Aromatica s.r.l. shall not be liable for any damage or loss caused by failures occurring as a result of manufacturing defects either to third parties or to the consumer. Such liabilities are in fact the sole responsibility of the original manufacturer, under the terms of the warranty provided by the latter.

   10. OBLIGATIONS OF THE PURCHASER The Purchaser undertakes
       and is obliged, once the online purchase procedure has been completed, to print and keep these General Terms and Conditions of Sale, as well as the specifications of the product purchased, in order to fully comply with the condition set out in articles 52 and 53 of Legislative Decree 06/09/2005 no. 206.

   It is strictly forbidden for the purchaser to enter false and/or third-party data in the registration procedure required to activate the process for the execution of the contract and further communications. Aromatica s.r.l. shall prosecute any violation and abuse, in the interest and for the protection of all consumers.

   11. CONTRACT TERMINATION AND EXPRESS TERMINATION CLAUSE
       Aromatica s.r.l. reserves the right to terminate the stipulated contract (order) by simply notifying the Consumer with adequate and justified reasons; in this case the Consumer shall only be entitled to the refund of any sum already paid.

   The obligations assumed by the purchaser (see section “Obligations of the purchaser”), as well as the guarantee of the successful completion of the payment made by the consumer in the manner provided for in the section “Payment”, are essential; therefore, the failure by the consumer, of only one of these obligations shall result in the termination of the contract by right pursuant to Article 1456 of the Italian Civil Code, without the need for a judicial ruling, without prejudice to the right for Aromatica s.r.l. to take legal action for compensation for any damages suffered.

13. TRANSACTION SECURITY

The E-Commerce software we use incorporates the best information encryption techniques according to the SSL (Secure Socket Layer) protocol. Therefore, all personal information and credit card details are sent over the Internet without prying eyes being able to reach them.

The use of an SSL Secure Server by the user is possible, in a completely transparent manner, using Safari, Netscape, Chrome, Internet Explorer or Firefox in one of the latest versions. These browsers are able to communicate in encrypted mode with Aromatica’s Secure Server (Secure Server, for the more technical), which will transmit your information to the banking circuit (again in encrypted mode) for verification.

When sending and receiving data in connection with an SSL Secure Server, masks are displayed indicating that secure areas have been reached (Hard Copy Form) and with the page address characterised by the prefix Https (note the final “s”).

Aromatica s.r.l. uses the SSL Secure Server for the transmission of credit card data. In practice: after selecting payment by credit card, you access a page that allows you to enter your data and then send them to the SSL Secure Server. Access to the SSL Secure Server only takes place when the data is actually sent. As long as the “Send Data” button is not pressed, there is no risk: the data remains on the user’s computer. Only afterwards do they enter the PayPal transaction circuit.

Transactions with PayPal take place under conditions of total security: all data is transmitted using the SSL (Secure Socket Layer) security system. The use of this technology means that confidential information travels over the Internet only in encrypted form, i.e. coded according to a complex mathematical algorithm that guarantees the confidentiality of communications and the inaccessibility of transmitted data.

14. JURISDICTION AND COMPETENT COURT
The present contract stipulated “online” through the e-commerce site zaffy.it shall be governed by Italian law. For any dispute relating to the validity, interpretation or execution of this contract, the territorial jurisdiction is of the judge of the place of residence or domicile of the consumer, if located in the territory of the State (Article 63 of Legislative Decree 06/09/2005 no. 206
